McDonald v. Household Int’l, Inc. et al
The 7th Circuit Court of Appeals handed down its decision today in McDonald v. Household Int’l, Inc. et al. The case was an appeal from a decision by Judge Richard Young of the Southern District of Indiana. Circuit Judge Wood, writing for a unanimous panel, concluded that although the district court was correct about ERISA preemption over state law, “the dismissal was premature. Parties do not need to plead legal theories in their complaints in federal court, and thus the McDonalds are entitled to go forward and litigate their claim under ERISA.”
